HueInk Terms of Service

1. Who we are

HueInk ("HueInk", "we", "us") is a service operated by [COMPANY NAME], a company registered in Romania, [REG. NO. / CUI], [REGISTERED ADDRESS], email support@hueink.com. The service is available at hueink.com and through the HueInk web app.

These Terms are a contract between you and us. By creating an account, starting a subscription or buying a HueInk licence you agree to them. If you don't agree, please don't use HueInk.

2. What HueInk does

HueInk helps you create social media posts made of a short text and an illustration, for example quote posts for Instagram. It includes a library of quotes and illustrations, tools to write new quotes and draw new illustrations with artificial intelligence (AI), an editor, and exports. Which features and limits you have depends on your plan (section 4) or on the licence and add-ons you bought (section 5).

3. Your account

  • You must be at least [16] years old to create an account.
  • Give accurate information and keep your login details safe. You are responsible for activity on your account. We ask you to confirm your email address, and we use a security check (captcha) when you sign up.
  • One account is for one person. Each plan or licence includes a set number of social media profiles (section 4); working for clients needs Studio or the Agency add-on.
  • One Free account per person. Creating several accounts to get more free posts or more trials is not allowed.

4. Plans

HueInk is offered as a Free plan, as subscriptions (Creator, Pro and Studio) and, through a separate one-time offer, as one-time licences (section 5). The current plans, prices and features are shown on hueink.com.

4.1 Free plan

  • The Free plan costs nothing and needs no payment details. It includes one new post per day (days run from 00:00 to 24:00 UTC), a starter selection of the quote and illustration libraries, the editor and PNG downloads, and one profile. It does not include writing or drawing new content with AI.
  • On the Free plan, the text and illustration of a post can be changed only on the day the post was created; you can move and resize them at any time.
  • Downloads on the Free plan carry a small "Made with HueInk" mark. Please don't remove it.
  • Free plan use is personal and non-commercial (section 4.4).
  • We may stop offering the Free plan to new sign-ups at any time. Accounts that already have the Free plan keep it.
  • If you end a paid plan or receive a refund, your account can move to the Free plan while we offer it.

4.2 Pro trial

  • A Free account with a confirmed email address and no paid plan can start one free 7-day trial of Pro features. Each account can use the trial once.
  • No payment details are needed and nothing is charged. During the trial the daily AI limits are those of the Creator plan (see the Fair Use Policy).
  • When the 7 days end, the account returns to the Free plan automatically. Posts you made stay in your account; features that need a paid plan are locked again.
  • We may stop offering the trial to new accounts at any time. Trials that have already started run to their end.

4.3 Subscriptions (Creator, Pro, Studio)

  • Billing. You choose monthly or annual billing at checkout. You pay in advance for each period: every month, or once a year. Annual billing costs 20% less than twelve monthly payments.
  • Automatic renewal. A subscription renews automatically at the end of each period, for a period of the same length, and the price is charged to the payment method you used, until you cancel. The price and the billing period are shown at checkout before you pay.
  • Cancel any time. You can cancel at any time in the member area of our checkout provider, PayMagick (the link is in your receipt email), or by writing to support@hueink.com. Cancelling stops future renewals. Your plan stays active until the end of the period you have already paid for, and you are not charged again. We don't refund the unused part of a period, except where the law requires it or as set out in section 7.
  • Changing plan or billing period. To move to another plan or billing period, contact us at support@hueink.com and we will help you switch without paying twice for the same period.
  • Failed payments. If a renewal payment fails, our checkout provider tries again for a few days and your plan keeps working during that time. If the payment still fails, the subscription ends and your account moves to the Free plan while we offer it.
  • Price changes. We may change subscription prices. We will tell you by email at least 30 days before a new price applies to you; it applies from your next renewal. If you don't agree, you can cancel before then.
  • When a subscription ends, your posts and files stay in your account. Features and limits follow the plan you then have.

4.4 What each plan lets you do (usage rights)

  • Free and Creator: personal, non-commercial use on your own personal accounts. Not for business or brand accounts, sponsored or paid posts, or advertising.
  • Pro: everything in Creator, plus use for your own business or brand accounts, monetized creator accounts, sponsored posts and your own advertising and marketing.
  • Studio: everything in Pro, plus client rights: you may create posts for clients and other people's businesses and sell them, as described for the Agency add-on in section 5.
  • Profiles included: Free 1, Creator 1, Pro 3, Studio 25.
  • Posts you published while a plan was active may stay published after the plan ends. New posts follow the rights of the plan you then have.

5. One-time licences and add-ons

  • What you buy. Through our one-time offer you can buy a licence with a single payment: a non-transferable licence for one person to use HueInk for as long as we operate the service ("lifetime licence"). There is no subscription and no automatic renewal.
  • Licence types.
    • Personal: the same usage rights as Creator (section 4.4): personal, non-commercial use on your own personal accounts.
    • Commercial: the same usage rights as Pro: everything in Personal, plus your own business or brand accounts, monetized creator accounts, sponsored posts and your own advertising and marketing. (One profile; more profiles with the Multi-Profile Studio add-on.)
    • Creating posts for clients or other people's businesses requires the Agency add-on.
    • You can upgrade from Personal to Commercial at any time by paying the difference.
  • Add-ons are one-time purchases attached to your licence, on the same terms, unless their description says otherwise: for example "Stories & Highlights Kit", "Carousels & Reels", "Multi-Profile Studio" (separate workspaces for up to 10, or 5, social media profiles you own or manage for yourself) and "Agency" (several brands or clients, and the right to create and sell posts for your clients; it includes Commercial use). Profiles are names you type in; HueInk does not connect to or post on any social network for you.
  • Updates. Licences and add-ons include all future updates of what they cover, at no extra cost, for as long as we operate the service. Entirely new products that are not part of what you bought may be offered separately.
  • If we ever close HueInk. We will give at least [90] days' notice by email, and you will be able to download your posts before the service closes.

6. Prices, payment and invoices

  • Prices are shown at checkout in [CURRENCY] and include VAT where applicable.
  • Payments are processed by [PAYMENT PROCESSOR] through our checkout (PayMagick). We do not store your card details. For subscriptions you authorise the recurring charges described in section 4.3.
  • You receive a receipt/invoice by email after each payment, including each renewal.

7. Right of withdrawal and refunds

  • Legal right of withdrawal (EU consumers). You normally have 14 days to withdraw from an online purchase, including the start of a subscription. Because HueInk is supplied immediately, at checkout we ask you to agree that access starts right away and to acknowledge that you lose the right of withdrawal once access starts (Romanian GEO 34/2014 transposing Directive 2011/83/EU). This applies to one-time licences, add-ons and the first period of a subscription. Renewals are not new contracts and have no new withdrawal period; you can cancel future renewals at any time (section 4.3).
  • The Free plan and the Pro trial are free, so no withdrawal question arises; you can stop using them and delete your account at any time.
  • Our 14-day money-back guarantee. Regardless of the above, if a one-time licence or add-on isn't for you, email us within 14 days of purchase and we'll refund you in full. Subscriptions are covered by the free trial and by cancelling any time (section 4.3) instead.
  • Refunds go back to the original payment method. A refunded purchase ends the licence, add-on or subscription it covered; the account can then move to the Free plan while we offer it.

8. Fair use

On paid plans and one-time licences, posts, library quotes, library illustrations and downloads are unlimited. The Free plan includes one new post per day. Creating brand-new content with AI has daily limits that depend on your plan, described in our Fair Use Policy, which is part of these Terms.

9. Your content and our content

  • Your posts. You own the posts you create and the text, signature and logos you add. You give us permission to store and process them only to run HueInk for you (for example to save, display, export or schedule them).
  • Library quotes and illustrations. They belong to us or our licensors, or are in the public domain. We give you a non-exclusive, worldwide, perpetual, royalty-free licence to use them in posts you create with HueInk, within the usage rights of your plan or licence (sections 4.4 and 5): personal use with Free, Creator or a Personal licence; also commercial and sponsored use for your own brands with Pro or a Commercial licence; also for clients with Studio or Agency. You may not: sell or distribute them on their own (for example as stock images, quote packs or printables made mainly of library content), include them in a competing product, or use them to train AI models. Public-domain works stay in the public domain.
  • AI-generated content. Quotes and illustrations you generate with AI are yours to use under the same terms as library content; to the extent we hold any rights in them, we grant them to you. AI output may not be protected by copyright, is not guaranteed to be unique, and could resemble existing works. Review it before you publish.
  • HueInk itself (the software, design, brand and the libraries as collections) remains ours.

10. Acceptable use

Don't use HueInk to:

  • break the law, or create content that is hateful, harassing, violent, sexually explicit or that sexualises minors;
  • infringe other people's rights, including copying other creators' texts, signatures, logos or brands, or impersonating someone;
  • mislead people, for example by hiding that a post is sponsored where the law requires you to say so;
  • send spam, or scrape, copy or resell the libraries;
  • reverse engineer the service, get around security or usage limits, or overload our systems. You are responsible for the posts you publish.

11. AI and transparency

HueInk uses AI models from third-party providers to write and draw new content. Images generated with AI carry machine-readable marking, as required by the EU AI Act. Don't remove it. We don't use your posts to train AI models.

12. Availability and changes to the service

We work to keep HueInk available and improving, but we can't promise it will be uninterrupted or error-free. We may change features, as long as the core of what you bought (creating, editing and downloading posts) stays available for the lifetime of your licence, or for the period you paid for on a subscription. We may need maintenance windows; we'll try to announce longer ones.

13. Suspension and termination

  • You can delete your account at any time from the Account page. Deleting the account does not cancel a subscription by itself: cancel it first (section 4.3), or write to us and we will do it for you.
  • We may suspend or close an account that seriously or repeatedly breaks these Terms or the Fair Use Policy, after a warning where reasonable. In serious cases (fraud, illegal content, attacks on the service) we may act immediately. If we close your account for a reason that isn't your fault, [we will refund you proportionally].
  • If you are a consumer, you keep all your statutory rights, including the legal guarantee that digital content conforms to the contract (Directive (EU) 2019/770, transposed in Romania by GEO 141/2021). Nothing in these Terms limits those rights.
  • Apart from those rights, and to the extent the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect losses such as lost profits or lost followers. These limits don't apply to liability for death or personal injury, fraud, gross negligence or wilful misconduct.

15. Privacy

How we handle personal data is explained in our Privacy Policy. This includes the security check (captcha) at sign-up, which is provided by Cloudflare.

16. Changes to these Terms

We may update these Terms. For changes that matter, we'll email you at least 30 days before they take effect. If you don't agree, you can cancel your subscription, stop using HueInk and delete your account before the change takes effect.

17. Law and disputes

  • These Terms are governed by Romanian law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer laws of your country.
  • Please contact us first at support@hueink.com; most issues are solved quickly.
  • Romanian consumers can contact ANPC (anpc.ro) and use alternative dispute resolution (SAL). The EU Online Dispute Resolution platform closed in July 2025.
  • Courts: the competent courts of Romania, without affecting a consumer's right to sue in their own country.
